PLEASE READ

These Terms govern purchases and use of Mufajat-operated digital services. They are designed primarily for UAE operations while preserving mandatory consumer rights that may apply to customers in Saudi Arabia and other destination markets.

1. About Mufajat and These Terms

Mufajat operates an e-commerce and customization service through mufajat.com, any Mufajat-operated mobile application, checkout, digital customization tools and other Mufajat-operated sales channels (together, the “Platform”). References to “Mufajat”, “we”, “us” or “our” mean the Mufajat business operating the relevant sale or service.

These Terms & Conditions (“Terms”), together with our Privacy Policy, Returns & Refunds Policy and any product-specific or promotional terms shown before purchase, govern your access to and use of the Platform and purchases made directly from Mufajat.

By accessing the Platform, creating an account, using a customization feature, or placing an order, you agree to these Terms. If you do not agree, please do not use the affected service or place an order.

Nothing in these Terms excludes, restricts or reduces any consumer right or remedy that cannot lawfully be excluded or waived.

2. International and Cross-Border Customers

Mufajat operates from the United Arab Emirates. These Terms are structured primarily around applicable UAE requirements. If an order is delivered to Saudi Arabia or another country, mandatory consumer-protection, e-commerce, privacy, product-safety or other rights that legally apply to that transaction remain unaffected.

If a provision of these Terms conflicts with a mandatory rule that applies to a consumer in the destination market, the mandatory rule will prevail to the extent of the conflict. This approach is intended to give international customers confidence that these Terms do not attempt to remove rights that local law makes non-waivable.

Orders placed through third-party marketplaces may also be subject to the marketplace’s mandatory terms, processes and buyer protections.

3. Eligibility, Accounts and Authority

The purchasing and account services are intended for adults aged 18 or over. A minor may use the Platform only under the supervision and responsibility of a parent or legal guardian where permitted by law.

You agree to provide accurate, current and complete information when creating an account or placing an order, and to update information where necessary for delivery or support.

You are responsible for keeping your login credentials confidential and for promptly notifying Mufajat if you reasonably believe your account has been compromised. Nothing in this clause excludes responsibility that Mufajat cannot lawfully exclude for its own acts, omissions or security obligations.

If you place an order on behalf of a company, school, team, organization or another person, you confirm that you have authority to do so and to provide the relevant instructions, content and payment authorization.

4. Products, Product Information and Availability

We aim to describe products, garment options, sizes, materials, colors, customization features, prices and availability accurately. Product images and lifestyle photography may be illustrative. The physical appearance of a product may vary reasonably because of lighting, screen settings, garment characteristics and production methods.

Products and variants are subject to availability. We may decline or cancel an order if an item is unavailable, a technical or pricing error is identified, payment cannot be verified, the requested content cannot lawfully or safely be produced, or another legitimate reason prevents fulfilment. If we cancel an already-paid order, we will refund the applicable amount using the original payment method where possible, subject to applicable law and payment-provider processing times.

5. Orders and Contract Formation

Product listings and customization tools allow you to submit an order. An automated acknowledgement that we received your order does not necessarily mean that the order has been finally accepted.

A purchase contract is formed when Mufajat confirms acceptance of the order, begins production of a customized item, or dispatches the product, whichever occurs first, subject to mandatory law.

Before placing an order, you are responsible for checking the product, size, color, quantity, delivery details, spelling, uploaded files, design preview and other customization selections. If you notice an error after ordering, contact support@mufajat.com immediately. We will try to help, but changes or cancellation may not be possible once production has started.

6. Prices, Taxes and Payment

Prices, delivery charges, applicable taxes and other mandatory charges will be shown before you complete checkout, as applicable to the transaction. The payment methods available to you are those displayed at checkout and may change from time to time.

You confirm that you are authorized to use the payment method submitted. We or our payment providers may carry out reasonable verification, fraud-prevention or authentication checks.

If an obvious pricing or system error affects an order, Mufajat may contact you before production or dispatch to offer the correct price or cancellation with a refund. We will not charge a higher corrected price without your agreement.

7. Customized and Personalized Products

Many Mufajat products are made specifically for the customer and may include uploaded artwork, photographs, names, text, AI-generated or AI-edited designs, matching designs, special print requests or other personalized instructions.

Customized products may enter production soon after an order is accepted. Once production has started, change-of-mind cancellation, return or exchange may be restricted as explained in our Returns & Refunds Policy and subject always to mandatory consumer rights.

Digital previews

A digital preview or mockup is a visual guide to help you review the intended design. Unless Mufajat has separately confirmed exact specifications in writing, a preview is not an exact production proof and does not guarantee a pixel-for-pixel or color-identical physical result.

Print size, placement and color variation

Reasonable variations may occur in print scale, dimensions, position, centering, alignment, color, shade, brightness, contrast and appearance across different garment sizes, fabrics, print methods, devices and screen calibrations. Minor or reasonable production variation is not by itself a product defect where the delivered product remains materially consistent with the confirmed order.

If you need a specific print dimension, exact placement, special color handling or another non-standard production requirement, contact support@mufajat.com before placing the order. The requirement must be expressly confirmed by Mufajat in writing before production to form part of the agreed specification.

8. AI-Assisted Design Services

Some Mufajat services allow you to create, edit, transform or personalize artwork using artificial intelligence (“AI”). AI outputs can involve artistic interpretation and may produce unexpected, approximate or non-identical details compared with an uploaded image, prompt or idea.

By choosing an AI-assisted service, you instruct Mufajat to process the content you provide for the purpose of generating or editing the requested design and fulfilling your order, in accordance with our Privacy Policy. Where third-party AI or technology providers are used, they may process information on our behalf subject to the safeguards and disclosures described in the Privacy Policy.

You must review the available design preview before placing the order. If you proceed with a preview, reasonable artistic interpretation or minor visual differences in the AI-generated design are not, by themselves, treated as a physical product defect. This does not affect your rights if the delivered item is defective, damaged, materially different from the confirmed design due to Mufajat’s error, or another remedy is required by law.

AI output may not always be unique, factually accurate or suitable for every purpose. Mufajat does not guarantee that an AI-generated design is exclusive to you. We may refuse, suspend or remove an AI request or output where we reasonably believe it is unlawful, unsafe, infringing, deceptive, abusive or otherwise unsuitable for production.

9. Your Photos, Designs, Prompts and Other Uploaded Content

You retain your rights in content that you lawfully own. By uploading or submitting content for a Mufajat service, you grant Mufajat a limited, non-exclusive permission to host, copy, process, resize, edit, transform and reproduce that content only as reasonably necessary to provide the requested customization, production, fulfilment and customer-support service, and to meet legal obligations.

You confirm that you have the legal right and permission to provide and use all submitted content. This includes permission from people shown in photographs and, where a child is depicted, the required parental, guardian or other lawful authority.

You must not upload or request content that infringes copyright, trademarks, publicity/privacy rights or other third-party rights; is unlawful, fraudulent, defamatory, threatening, hateful, discriminatory, obscene or sexually exploitative; depicts or facilitates illegal activity; or otherwise violates applicable law or Mufajat’s published content rules.

Private customization uploads are not automatically licensed to Mufajat for advertising or public marketing. We will not treat a private order photo as public user-generated content merely because it was uploaded for customization. Any marketing or social-media use of a customer’s private photo or finished personalized product should be based on separate permission where required.

10. Intellectual Property Rights

The Mufajat name, logos, website design, original brand materials, software, interface elements, product photography, copy and other Mufajat-owned content are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, license, scrape or commercially exploit Mufajat-owned content without prior written permission.

A purchase of a physical product does not transfer ownership of Mufajat’s trademarks, platform technology or third-party intellectual-property rights incorporated in that product or service.

If Mufajat reasonably receives a credible intellectual-property complaint concerning customer-supplied content, we may pause or cancel production, remove the content, request evidence of permission, or take other reasonable steps. If an order cannot lawfully be fulfilled, any refund will be handled according to the circumstances, applicable law and our policies.

11. Public Reviews, Ratings and User-Generated Content

If you voluntarily submit a public review, rating, comment, testimonial or other content intended to be displayed publicly, you grant Mufajat a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format and use that public content for operating and promoting Mufajat and the relevant products, subject to applicable law.

This public-content licence does not apply to private customization uploads. We may moderate or remove public content that is unlawful, misleading, abusive, infringing, irrelevant, spam, or otherwise violates these Terms or platform rules.

12. Shipping, Delivery and Failed Delivery

Available delivery methods, estimated delivery timing and charges will be shown on the Platform or during checkout where applicable. Delivery estimates are not guarantees unless Mufajat expressly confirms a guaranteed service.

You are responsible for providing a complete and accurate delivery address and reachable contact details. If a delivery problem is caused by materially incorrect customer information or repeated inability to receive the shipment, reasonable re-delivery costs may apply where permitted by law and disclosed to you.

If delivery is materially delayed, lost or otherwise fails, contact support@mufajat.com. Any statutory cancellation, refund or other rights arising from delay remain unaffected. We may also offer a practical replacement, re-delivery or refund depending on the circumstances.

13. Returns, Refunds, Exchanges and Cancellations

Returns, refunds, exchanges and cancellations are governed by the Mufajat Returns & Refunds Policy, which forms part of these Terms.

Eligible non-customized products may benefit from Mufajat’s published commercial return period. Customized and personalized products are generally not returnable for change of mind once production has started, subject to applicable law. Defective, damaged, incorrect or materially non-conforming products remain eligible for the remedies required by applicable law and our Returns & Refunds Policy.

Where a marketplace’s mandatory return process applies to an order, you may need to initiate the request through that marketplace.

14. Promotions, Discount Codes and Offers

Promotions, discount codes, bundles, limited-time offers and campaigns may have additional terms, validity periods, eligibility rules, redemption limits or exclusions displayed with the offer. Unless otherwise stated, offers are subject to availability and may not be combined.

We may refuse or reverse a promotion where there is a clear technical error, fraud, abuse, manipulation or use contrary to the published offer terms. Nothing in this clause permits misleading pricing or advertising or removes mandatory consumer rights.

15. Business, Team and Bulk Orders

Business, team, school, event and bulk orders may be subject to a separate written quotation, artwork approval, lead time, payment schedule, minimum quantity, production specification or commercial terms. If a separate written agreement conflicts with these Terms, the specific written agreement will control for that business order to the extent permitted by law.

Consumer-protection rights intended for individual consumers may not apply in the same way to genuine business-to-business purchases. Any rights that do apply by law remain unaffected.

16. Electronic Communications

You agree that order confirmations, receipts, delivery updates, support messages, policy notices and other service communications may be provided electronically using the contact details you supply, where permitted by law.

Promotional marketing is separate from service communications. We will provide marketing choices and opt-out methods in accordance with our Privacy Policy and applicable law. Creating an account or buying a product does not by itself override any legal requirement for marketing consent.

17. Acceptable Use of the Platform

You must not misuse the Platform or attempt to interfere with its security, availability or operation. In particular, you must not:

·       access accounts, systems or data without authorization;

·       introduce malware, malicious code, automated attacks or harmful technologies;

·       attempt unauthorized vulnerability testing, credential attacks or circumvention of security measures;

·       scrape or extract Platform data at scale without permission where prohibited by law or these Terms;

·       use the Platform for fraud, impersonation, unlawful activity or infringement of third-party rights;

·       manipulate payment, promotion, referral, review or ordering systems; or

·       use Mufajat services in a manner that materially harms other customers, Mufajat, its providers or the lawful operation of the Platform.

We may reasonably suspend, restrict or terminate access where necessary to protect users, investigate suspected abuse, comply with law or enforce these Terms. Where appropriate and legally required, we will provide notice or an opportunity to address the issue.

18. Third-Party Services and Links

The Platform may rely on or link to third-party services such as Shopify or other commerce technology, payment gateways, couriers, analytics tools, social platforms, AI providers and marketplaces. Those providers may have their own terms and privacy notices.

Mufajat is responsible for its own obligations and will not attempt to exclude responsibility that applicable law places on it for providers acting on its behalf. However, we are not responsible for independent third-party websites or services that you choose to access outside the Mufajat transaction, except to the extent required by law.

19. Platform Availability and Changes

We may update, improve, maintain, suspend or discontinue Platform features from time to time. We aim to keep the Platform available and secure but do not guarantee uninterrupted or error-free access at all times.

Planned maintenance, outages, telecommunications failures, force-majeure events or circumstances beyond reasonable control may temporarily affect service. This clause does not remove any statutory remedy relating to an affected purchase or paid service.

20. Disclaimer and Limitation of Liability

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited, including mandatory consumer rights and any other non-waivable liability under applicable law.

To the fullest extent permitted by law, Mufajat is not responsible for indirect, incidental or consequential losses that were not reasonably foreseeable from the transaction, or for loss arising solely from customer-provided incorrect information, unlawful content, unauthorized use of an account by the customer, or use of the Platform contrary to these Terms.

For consumer purchases, Mufajat remains responsible for direct remedies required by applicable consumer law, including where a product is defective, damaged, materially misdescribed or materially fails to match the agreed order because of Mufajat’s act or omission.

For genuine business-to-business orders only, and to the fullest extent permitted by law, Mufajat’s aggregate contractual liability relating to a particular order will not exceed the amount paid to Mufajat for the affected order, except for liability that cannot legally be limited or where a separate written business agreement provides otherwise.

21. Customer Responsibility and Indemnity for Unlawful Content

You are responsible for the legality of content, images, logos, names, text and instructions that you provide for customization. To the extent permitted by law, if a third party makes a claim against Mufajat solely because content supplied by you unlawfully infringes that third party’s rights or violates applicable law, you agree to reimburse Mufajat for reasonable, documented losses and costs finally awarded or agreed in settlement, provided Mufajat gives you reasonable notice and does not seek recovery for losses caused by Mufajat’s own independent wrongdoing.

This is a limited content-related indemnity. It is not intended to make consumers responsible for matters that are legally Mufajat’s responsibility.

22. Privacy and Personal Data

Our collection, use, storage, disclosure, international transfer and deletion of personal information are governed by the Mufajat Privacy Policy. The Privacy Policy also explains how uploaded photos and AI-assisted customization files are handled, the role of service providers and the privacy rights that may apply to you.

Where applicable law requires consent for a specific processing purpose, these Terms do not replace that consent. Separate notices or choices may be presented during upload, checkout, marketing sign-up or other relevant interactions.

23. Changes to These Terms

We may update these Terms to reflect changes in our services, technology, business operations or legal obligations. The updated version will be published with a revised “Last updated” date.

Changes will apply prospectively unless applicable law permits otherwise. Material changes will not retroactively reduce rights already attached to an accepted order. Where law requires additional notice or consent, we will provide it.

24. Governing Law and Dispute Resolution

Subject to any mandatory consumer-protection, jurisdiction or dispute-resolution rules that apply to you and cannot legally be waived, these Terms and purchases made directly from Mufajat are governed by the laws of the United Arab Emirates.

We encourage customers to contact support@mufajat.com first so we can try to resolve any concern promptly. If a dispute cannot be resolved informally, it may be submitted to the competent courts or consumer-protection authority in the UAE, including Dubai where jurisdiction is properly established, subject to any mandatory rights a consumer may have to bring a claim before another competent authority or court.

For customers in Saudi Arabia or another destination market, nothing in this clause is intended to deprive you of a mandatory local forum, regulator or remedy that applicable law makes available to you.

25. Severability, Waiver and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. The invalid provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful and effective where possible.

If Mufajat does not enforce a provision immediately, that does not permanently waive the right to enforce it later.

These Terms, together with the policies and order-specific information incorporated by reference, form the agreement governing your use of the Platform and direct purchase, unless a separate written agreement applies.
